RENTAL AGREEMENT & RELEASE WAIVER

EQUIPMENT LEASE AGREEMENT

This Equipment Lease Agreement ("Lease") is made effective by clicking the "I agree, submit order" or similar button, between Wild Rigs LLC ("Lessor"), located in 418 Broadway STE R, Albany, NY 12207, and the user ("Lessee"). By clicking the "I agree" button, Lessee agrees to the terms of this Lease, whether or not they have read them. Lessor may modify these terms at any time, and by clicking "I agree," Lessee accepts the updated terms.

1. Disclaimer

Wild Rigs LLC makes efforts to ensure accurate descriptions and prices but reserves the right to correct any errors. All prices and availability are subject to change without notice.

2. Lease

Wild Rigs LLC leases the equipment ("Equipment") listed in the "Cart" during checkout and on the itemized Invoice in the "Product" column to Lessee, and Lessee agrees to lease it from Wild Rigs LLC.

3. Shipping & Delivery

Wild Rigs LLC ships all equipment directly to the Lessee's door. Shipping is included in the rental price unless otherwise stated. Wild Rigs LLC does not guarantee delivery times and cannot be held liable for shipping delays, lost, or damaged shipments. If Equipment is delayed or lost during shipping, Wild Rigs LLC will refund the rental days the equipment was unavailable.

Lessee must inspect the delivery and report any issues within 24 hours via email to team@wildrigs.com. A prepaid return shipping label is included in every kit. Lessee must use this label to return Equipment. Use of any unauthorized shipping method will make Lessee responsible for any resulting loss or damage.

4. Rental Term

The Lease begins when the shipper attempts delivery or on the first rental day, whichever is later, and ends on the last rental day specified in the order confirmation. The Equipment must be returned by the end of the term to avoid penalties. Lessee will have 1 day after the rental end date to pack and return the Equipment using the provided prepaid label.

5. Rent & Payment

All rental fees must be paid in full at the time of the order. Wild Rigs LLC accepts major credit and debit cards through our secure checkout.

6. Late Returns

Late returns incur a maximum daily penalty of 25% of the 3-day rental rate. If the Equipment is not returned within 7 days of the due date, Lessee will be charged the full replacement cost of the Equipment. Failure to pay penalties or replacement costs within 7 days will result in Default, and Wild Rigs LLC may pursue civil and criminal remedies.

7. Responsible Use

Lessee agrees to use the Equipment responsibly, treat it with care, and comply with all applicable laws including public lands, fish, and wildlife regulations. Equipment may not be transferred to third parties.

8. Cancellation & Modifications

Cancellation by Wild Rigs LLC

Wild Rigs LLC may cancel any order at any time before delivery. A full refund will be issued in the event of cancellation by Wild Rigs LLC.

Cancellation by Lessee

Lessee may cancel or modify an order subject to the following policy:

  • 10 or more days before rental start date: Full refund

  • 6–9 days before rental start date: 50% refund

  • Under 6 days before rental start date: No refund

  • Rescheduling is free with 6 or more days notice. Under 6 days, rescheduling is subject to availability only.

9. Ownership

All Equipment remains the sole property of Wild Rigs LLC at all times. Lessee has no ownership rights to the Equipment.

10. Damaged or Modified Equipment

Lessee is responsible for keeping the Equipment in good condition and may not alter, modify, or attempt to repair it. Lessee will bear the cost of any repairs due to damage or misuse, except in cases of shipping damage which must be reported within 24 hours of delivery.

A cleaning fee will be applied if Equipment is returned excessively dirty or with thick mud. All gear must be spot dried and free of debris before being returned. Wild Rigs LLC reserves the right to determine the method and cost of any required repairs or cleaning.

11. Loss of Equipment

Lessee assumes the risk of loss of Equipment during the Lease term. If Equipment is lost or stolen, Lessee is responsible for the full replacement cost. If Equipment is not returned within 7 days after the rental term ends, Lessee will be charged the full replacement cost. Tracking information and return receipts will be used to verify returns.

12. Security Deposit

A security deposit will be authorized on the Lessee's account at the time of rental. This deposit is fully refundable if all Equipment is returned on time, in undamaged condition, with no missing items, and properly cleaned. Wild Rigs LLC reserves the right to retain part or all of the deposit to cover late fees, cleaning fees, or replacement costs. The deposit will be released within 3–5 business days of completed return and inspection.

13. Return Checklist

Lessee must verify all items are included before sealing the return bag. Missing items will result in a replacement fee. A checklist is included in your kit for reference.

14. Release of Liability & Indemnity

Although Wild Rigs LLC strives to provide quality, trail-tested gear, it also acts as a supplier of third-party goods. The Lessee acknowledges that Wild Rigs LLC will not be liable for any claims, damages, or breaches of warranty arising from the use of Equipment. Lessee agrees to indemnify and defend Wild Rigs LLC and its founders, agents, and affiliates from any civil liability arising from the use of Wild Rigs LLC Equipment.

Lessee agrees to review all manufacturer warnings before using Wild Rigs LLC Equipment and acknowledges their responsibility for how the Equipment is used during the rental period.

15. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of the State of New York. Any disputes arising from this Agreement shall be filed in New York County, New York.

16. Attorney's Fees

The prevailing party in any legal action to enforce these terms will be entitled to reimbursement of reasonable legal fees and costs.

17. Class Action Waiver

Lessee agrees to resolve any disputes with Wild Rigs LLC individually and waives the right to participate in any class or collective legal action.

18. Tax Notice

Certain states may require sales tax to be collected on rental transactions. Any applicable taxes will be displayed at checkout.

19. Email Communications

By placing an order or creating an account with Wild Rigs LLC, the Lessee consents to receiving order-related and promotional emails from Wild Rigs LLC. Lessee may opt out at any time by clicking unsubscribe.

20. Trademarks & Copyright

All content on wildrigs.com is protected by copyright. Trademarks and logos associated with Wild Rigs LLC are the exclusive property of Wild Rigs LLC.


RENTAL RELEASE WAIVER

Customer Hold Harmless Waiver

Wild Rigs LLC reserves the right to deny rentals to any individual at its discretion to prevent fraud and ensure the safety of its Equipment and community. In the event of cancellation, a refund will be issued in accordance with our cancellation policy.

Customer Affidavit

By selecting "I Agree, Submit Order," the customer (Lessee) affirms the following:

  • I will comply with all applicable laws during any trip involving Wild Rigs LLC Equipment.

  • I accept full responsibility for the replacement value of any Equipment lost, stolen, or confiscated while in my possession.

  • I will inspect the Equipment upon receipt and report any discrepancies within 24 hours to team@wildrigs.com.

  • I accept responsibility for repair, replacement, or cleaning costs for Equipment damaged or soiled during my possession, excluding shipping damage.

  • I will return all Equipment dry, clean, and complete using the prepaid return label provided.

  • I understand that missing items will result in a replacement fee charged to my payment method on file.
